Refugees and Women’s Rights were Discussed at the Human Rights Summit Held in IMU

The Human Rights Summit, organized by Aydın Civilizations Academy Student Club of our university was held on Wednesday, March 16, 2022, in the Aşıkpaşa Conference Hall of the South Campus of our university, between 12.50 and 15.30.

Guests Apak Kerem ALTINTOP, Lect.PhD. Zeynep ARDIÇ of IMU Faculty of Law, and Att. Onur TATAR  discussed the refugee law and fundamental rights and freedoms.

After explaining the legal dimension of the concept of refugee in his speech titled “Refugees in Europe and Turkey”, Mr. ALTINTOP touched upon the reasons for the increasing number of refugees in the world. He stated that global policies and the use of force prohibited by the UN Charter are quite triggers of the migration. On the other hand, he touched upon the protection of fundamental rights and freedoms of refugees in the light of the 1951 Convention on the Legal Status of Refugees and the European Convention on Human Rights.

 Dr. ARDIÇ, on the other hand, explained the constitutional basis of freedom of expression in her speech titled “Freedom of Expression in Turkey” and explained the rules that are essential in limiting this right in the light of ECtHR case law. She explained that the freedom of expression includes the freedom to express one’s thoughts, as well as the freedom not to express them, and the freedom to disseminate ideas and thoughts is also within the scope of it. Later, she compared the case-law of the Constitutional Court with the case-law of the ECtHR and drew attention to the differences.

Mr. TATAR, also explained the interpretation of the right to life in the light of jurisprudence of the court in his speech titled “The Right to Life and Femicide under the ECHR”. Evaluating femicides on the basis of the right to life, TATAR explained that issues such as gender inequality, gender discrimination, domestic violence, and forced marriages play a role in femicides, and states have important positive obligations in terms of the right to life in the context of femicides. He stated that the events which could constitute intervention in the victim’s right to life, that occurred after the victim applied to the local state authorities may invoke the state responsibility in terms of positive obligations of the states.
